Terms of service
Who we are
Fuerza Studios is a general partnership of A.J Organ, T.R Parsons, N Trzesinski-Smith and G Zissopoulos, ABN 81 214 352 297. In these
terms, "we", "us" and "Fuerza Studios" refer to that partnership, and "you" refers to the person or organisation placing the order.
Orders and minimums
Minimum order quantity is 20 garments. Orders are for custom, made-to-order goods produced to your specification. Placing an order
constitutes an offer, which we accept when we confirm the order in writing.
Pricing, GST and payment
All prices are in Australian dollars. Fuerza Studios is not registered for GST, so no GST is charged and prices do not include a GST
component. We issue invoices, not tax invoices.
Full payment is required upfront. Production does not commence until payment has cleared and you have approved your artwork proof.

Cancellation and changes
Once payment has cleared, your order is confirmed and cannot be cancelled or amended. This reflects the fact that blanks are ordered
and print set-up is prepared specifically for your job and cannot be reallocated.
If you need to change artwork, quantities or the name and number list, contact us immediately at Fuerzastudios100@gmail.com. We will
accommodate changes where production allows, and any change may attract additional cost.
Artwork, proofs and approval
You are responsible for supplying artwork in a usable format. We will provide a digital proof for your written approval before production
begins. On orders above 100 garments we will also provide a physical sample at no charge; physical samples on smaller orders are
available at cost.
Approval of the proof is final. Once you approve a proof, you accept the artwork, spelling, layout, placement and colour as shown, and
any error present in the approved proof is your responsibility. Reprints arising from an approved proof are charged at full price.
Intellectual property in artwork you supply
This clause is important. By submitting artwork, logos, marks, names, images or other material to us, you warrant that:
(a) you own that material, or hold a valid licence or authorisation to reproduce it on garments for the purpose of your order; and
(b) our reproduction of it will not infringe the intellectual property rights, moral rights or any other rights of any third party.
You indemnify Fuerza Studios and its partners against all claims, losses, damages, costs and legal expenses arising from a breach of that
warranty, including any claim brought by a rights holder, licensor, league or governing body.
We may decline any order, at our discretion and without giving reasons, where we hold concerns about the rights in material supplied.
Where we decline before production commences, we will refund you in full.
You retain ownership of your artwork. You grant us a non-exclusive licence to reproduce it for the purposes of fulfilling your order, and
to photograph finished goods for our portfolio and marketing unless you tell us in writing that you would prefer we did not.
Colour, materials and finish
Garments are printed on AS Colour blanks. Colours displayed on screens vary between devices and are not an exact representation of
the finished product. Minor variation between dye lots, and minor variation between the approved proof and the finished garment in
colour, print position and finish, is inherent to the process and does not constitute a fault.
Where exact colour matching matters to you, request a physical sample before approving your proof.
Production and delivery times
Standard production time is 16 business days from the later of payment clearing and proof approval. This is production time only and
does not include transit. Production times are estimates given in good faith and are not guaranteed. Where a deadline is critical — a
season start, a tournament, an event — tell us before you order and we will confirm in writing whether it is achievable.
Consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. See our return and refund policy for how
those guarantees apply.
Limitation of liability
To the maximum extent permitted by law, and other than in respect of rights and remedies that cannot lawfully be excluded, our total
liability arising from any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss,
including loss of profit, loss of sponsorship, or loss arising from an event proceeding without the goods.
Governing law
These terms are governed by the law of South Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
Changes to these terms
We may update these terms from time to time. The terms applying to your order are those published at the time you placed it.
